Release and Waiver

For Olin Pier

I recognize that boating and the use of a pier involves some risk of accident, injury or death. I understand these risks. I, for myself, my spouse and children and personal representatives, assigns, heirs, and next of kin, hereby release, waive, and discharge the City of Madison, its officials, officers, employees, and agents (releasees), from all liability to myself, my spouse and children and my personal representatives, assigns heirs, and next of kin for all injury or death to me or to my spouse or children, whether caused by negligence of releasees, negligence of others using the facilities, condition of the facilities or otherwise caused in any manner by participation or use of the pier by me, members of my family, guests and invitees.

I hereby assume full responsibility for any risk of injury or damage due to negligence of releases, condition of the facilities or otherwise caused in any manner by the use of the facilities.

I expressly agree that this waiver is intended to be as broad and as inclusive as permitted by the laws of theState of Wisconsin and that if any portion thereof is held invalid, it is agreed that the balance should
continue in full force and effect.

This waiver contains the entire agreement between the parties hereto and the terms of this release are
contractual and not a mere recital. I further state that I have read the foregoing agreement and I know and understand the contents thereof..
